If you decide to file a complaint with the EEOC, you may also have the option to file a lawsuit in federal court if you obtain a “Right to Sue” letter from the EEOC. Similarly, if you choose to file a lawsuit directly in New Jersey Superior Court, you have two years from the act of sexual harassment to do so. However, keep in mind that you cannot file a complaint with the New Jersey Division on Civil Rights simultaneously.
